BREAKING | Supreme Court Grants Interim Relief to Student Protesters, Orders Immediate Release of Detained Minors

In a significant development concerning the protection of constitutional rights and civil liberties, the Supreme Court of India on Monday granted interim relief to student protesters by directing that no coercive action shall be taken against eligible protesters across the country until further orders.

The directions were issued during the hearing of petitions alleging excessive police action against students who participated in recent nationwide protests. The petitioners alleged that peaceful demonstrators were subjected to lathi charges, tear gas shelling, arbitrary detentions, and criminal proceedings in several States.

Key Interim Directions

While hearing the matter, the Supreme Court issued the following interim directions:

* No coercive action shall be taken against student protesters covered under the Court’s interim protection until the next hearing.

* All detained or arrested protesters below the age of 18 years, who have no criminal antecedents, shall be released immediately in accordance with law.

* Police authorities have been directed to preserve all digital evidence, including CCTV footage, mobile phone videos, body-camera recordings, and other electronic material relating to the protests.

* The Court also directed that the personal digital data of student protesters shall not be publicly disclosed or misused, emphasizing the need to safeguard their privacy while the proceedings remain pending.

Court Expresses Concern

The Bench observed that allegations of excessive use of force by law enforcement agencies raise serious constitutional concerns and require an impartial examination. The Court indicated that it is considering the constitution of an independent Special Investigation Team (SIT) under the supervision of a former Supreme Court judge to investigate the incidents and determine whether police action remained within the bounds of law.

The judges reiterated that peaceful protest is a fundamental constitutional right and forms an essential pillar of India’s democratic framework. At the same time, the Court observed that demonstrations must remain peaceful and should not result in violence or destruction of public property.

Notices Issued to Governments 

The Supreme Court has issued notices to the Union Government and the concerned State Governments, seeking their responses to the allegations raised in the petitions. The matter will now be heard further after the authorities place their replies on record.

Legal experts believe the interim order is likely to have far-reaching implications for the protection of the right to peaceful protest and may shape future guidelines governing police action during public demonstrations.
